Terms of Service

1. Agreement to Terms
These Terms of Service ("Terms") form a legally binding agreement between you and Kamase Labs Inc., operating as Barry ("Barry," "we," "us," or "our"). By accessing or using our website at www.hirebarry.com (the "Site"), our web application at app.hirebarry.com (the "Dashboard"), our AI tools accessed through messaging channels including SMS, MMS, RCS, Apple Messages (iMessage / Messages for Business), WhatsApp, and Telegram (collectively, the "Messaging Services"), any connected third-party integrations, or any related services (collectively, the "Service"), you agree to be bound by these Terms.
If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms. If you do not agree, do not access or use the Service.
2. Description of Service
Barry is an AI-powered operations assistant designed for trades and home services businesses (such as construction, plumbing, HVAC, electrical, and landscaping). The Service includes:
- Messaging-based field documentation: Team members text photos, voice memos, and updates to Barry through the Messaging Services. These are automatically processed, tagged, timestamped, and organized by project.
- AI reports and summaries: Automated summaries generated from actual field activity, delivered to managers.
- Issue tracking: Automatic logging, flagging, and assignment of issues reported through the Messaging Services.
- Dashboard: A web-based command center where managers view all sites, updates, and team activity in one place.
- Q&A and recommendations: Team members can ask Barry questions and receive AI-generated answers and recommendations drawn from real-time project data.
- Schedule and task management: Task assignment through the Dashboard with delivery to the field through the Messaging Services.
- Third-party integrations: Optional connections to other tools and services you authorize.
We may update, modify, or discontinue features of the Service at any time. We will make reasonable efforts to notify you of material changes.
3. Eligibility
You must be at least 18 years old and capable of forming a binding contract to use the Service. The Service is intended for use by trades and home services professionals and businesses. By using the Service, you confirm that you meet these requirements.
4. Account Registration
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Keep your account credentials secure and confidential.
- Notify us immediately of any unauthorized access to your account.
- Accept responsibility for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.
5. Waitlist and Early Access
We operate a waitlist and may offer early-access or beta versions of the Service. By submitting your email address to our waitlist, you consent to receiving communications from Barry about your waitlist status, product updates, and onboarding information. You may unsubscribe from these communications at any time by contacting us at team@hirebarry.com. Features identified as early access or beta are provided "as is" and "as available," may change or be discontinued at any time, and are excluded from any service-level commitment.
6. Messaging Channel Terms
Barry communicates with you across several messaging channels. By using the Messaging Services, you acknowledge and agree that:
- Content you send through the Messaging Services (including photos, voice memos, and text messages) will be processed by our AI systems and stored as part of your project records.
- Voice memos will be automatically transcribed. Transcriptions may not be perfectly accurate.
- Photos may carry GPS coordinates and other metadata already embedded in the image file, which we use to organize project documentation.
- You are responsible for ensuring that all individuals who interact with the Service through the Messaging Services on your behalf are aware of and consent to these Terms and our Privacy Policy.
- Each messaging channel is operated by a third party (such as your carrier, Apple, Meta/WhatsApp, or Telegram) and is subject to that provider's terms and policies.
6.1 SMS / MMS / RCS
If you opt in to receive text messages, standard message and data rates from your carrier may apply, and message frequency may vary. Consent to receive messages is not a condition of purchase. You may opt out at any time by replying STOP (or another reasonable opt-out request, such as STOP, END, CANCEL, UNSUBSCRIBE, or ARRÊT), and you may reply HELP for assistance. We honor opt-out requests promptly. As a Canadian business, we identify ourselves as the sender and provide a functional unsubscribe mechanism as required by applicable anti-spam law (including Canada's CASL).
6.2 Other Channels
Apple Messages, WhatsApp, and Telegram are internet-based, so carrier message-and-data-rate charges do not apply to those channels. For WhatsApp, we message you only after you opt in, and you may opt out at any time. You agree not to use any messaging channel in a manner that violates the applicable platform's policies (including Meta's and Telegram's messaging and commerce policies).
7. AI-Generated Content and Recommendations
The Service uses artificial intelligence to generate reports, process updates, answer questions, organize project data, and produce recommendations ("AI Output"). AI Output is generated by probabilistic (statistical) models, including models operated by our third-party AI providers. You acknowledge and agree that:
- AI Output is provided "as is" and for informational and decision-support purposes only. It may be incomplete, inaccurate, out-of-date, or entirely fabricated ("hallucinated"), even when presented in a confident or authoritative tone. All AI Output should be treated with appropriate caution and independently verified before being relied upon.
- Any recommendation, suggestion, ranking, or prediction the Service provides is informational only. It is not a directive, guarantee, or assurance of any outcome, and you retain full and sole responsibility for any decision you make.
- AI Output does not constitute, and is not a substitute for, professional advice — including legal, financial, accounting, tax, engineering, architectural, or safety advice.
- You are solely responsible for reviewing, verifying, and exercising your own independent professional judgment before relying on or acting upon any AI Output, and you remain solely responsible for all operational decisions, safety compliance, and regulatory obligations.
8. Your Content
"Your Content" means any data, text, images, photos, voice recordings, documents, or other materials you or your team submit through the Service. You retain ownership of Your Content. By submitting Your Content to the Service, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify (for example, to format, transcribe, or display), process, and otherwise use Your Content solely for the purpose of providing, securing, maintaining, and improving the Service and as permitted by our Privacy Policy.
We do not use Your Content to train, fine-tune, or improve our own or any third party's AI models. You represent and warrant that you have the right to submit Your Content and that it does not violate any third party's rights or any applicable law. You are responsible for the accuracy of project data entered into the Service and for maintaining your own backup copies of Your Content.
9. Feedback
From time to time you may choose to provide suggestions, enhancement requests, recommendations, feature ideas, or other feedback regarding the Service ("Feedback"). You grant Barry a royalty-free, fully paid-up, worldwide, transferable, sublicensable, irrevocable, and perpetual license to use, disclose, reproduce, modify, commercially exploit, and incorporate the Feedback into our products, services, and documentation, for any purpose and without any obligation or compensation to you.
For clarity, Barry exclusively owns all improvements, modifications, features, and other developments it creates that are based on, derived from, or incorporate Feedback, including any such functionality we build into the Service. You acquire no ownership or other interest in those developments. This Section survives termination of these Terms.
10. Acceptable Use
You agree not to use the Service to:
- Violate any applicable federal, provincial, state, or local law or regulation.
- Submit false, misleading, or fraudulent information.
- Interfere with or disrupt the Service or its infrastructure.
- Attempt to gain unauthorized access to any part of the Service.
- Use the Service for any purpose other than operating your trades or home services business.
- Reverse engineer, decompile, or attempt to extract the source code of the Service.
- Use automated means to access the Service except through our published APIs.
- Violate the usage policies of our third-party AI providers (see Section 11).
11. Third-Party AI Providers
The Service relies on third-party AI models and services, currently provided by Anthropic (Claude), Google (Gemini), and OpenAI. When you use AI features, you also agree to comply with those providers' applicable usage policies, as updated from time to time, and not to use the Service in any manner those policies prohibit. As described in our Privacy Policy, we use these providers under their commercial API terms, under which your content is not used to train their models, and we do not use your content to train our own models.
12. Third-Party Services and Integrations
The Service integrates with or relies on third-party services, including messaging platforms and carriers, cloud hosting providers, analytics tools, and any integrations you choose to connect. We are not responsible for the availability, reliability, or practices of third-party services. Your use of third-party services is subject to their respective terms and policies.
13. Free Trials, Pricing, and Payment
Pricing for the Service is displayed on our website and may change from time to time. We will provide at least 30 days' notice before any price increases take effect for existing subscribers. All fees are quoted in US dollars unless otherwise stated.
We may offer a free trial for new accounts. If you do not cancel before the end of your free trial, your subscription will automatically begin and your payment method will be charged the applicable subscription fee. Paid subscriptions then automatically renew at the then-current price for successive billing periods (for example, monthly or annually) unless you cancel before the renewal date. By subscribing or continuing past a free trial, you authorize Barry (through our payment processor) to charge your payment method on each renewal until you cancel.
You may cancel at any time through the Dashboard or by contacting team@hirebarry.com, with cancellation effective at the end of the current billing period. Where required by law, we will provide renewal reminders and clear cancellation instructions, and cancellation will be at least as easy as signup. If you initiate a chargeback or payment dispute, we may suspend your account pending resolution; we ask that you contact us first to resolve any billing issue.
14. Cancellation and Termination
You may cancel your subscription at any time through the Dashboard or by contacting us at team@hirebarry.com. Cancellation takes effect at the end of your current billing period. Except where required by law, fees are non-refundable and we do not provide prorated refunds for partial periods.
We may suspend or terminate your access to the Service if you violate these Terms, fail to pay fees when due, or if we reasonably determine that your use of the Service poses a risk to us or other users. We will make reasonable efforts to provide notice before termination except where immediate action is required.
Upon termination, you may request an export of Your Content for up to 30 days. After that period, we may delete Your Content in accordance with our data retention practices.
15. Intellectual Property
As between you and Barry, Barry and its licensors own all right, title, and interest in and to the Service, including its design, features, software, AI models and systems, algorithms, user interfaces, code, documentation, and branding, together with all improvements, modifications, and derivative works thereof. The Service is protected by Canadian and international intellectual property laws. Except for the limited rights expressly granted to you in these Terms, no rights are granted to you by implication, estoppel, or otherwise, and all rights not expressly granted are reserved.
"Barry" and related logos and marks are trademarks of Kamase Labs Inc. You may not use our trademarks without prior written permission.
16. Modification of the Service
We may modify, suspend, or discontinue the Service (or any part or feature of it) at any time. For material adverse changes to paid features, we will provide reasonable advance notice where practicable. The Service is provided on an "as available" basis, and we do not guarantee that it will be uninterrupted; any service-level commitment applies only if set out in a separate written agreement.
17. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Without limiting the foregoing, we do not warrant that:
- The Service will be uninterrupted, error-free, or secure.
- AI Output will be accurate, complete, or suitable for any particular purpose.
- The Service will meet your specific requirements.
- Defects will be corrected in any particular timeframe.
Trades and home services work is inherently complex and high-stakes. The Service is a tool to assist with operations and documentation. It is not a substitute for qualified professional judgment, on-site inspections, or compliance with building codes and safety regulations.
18. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KAMASE LABS INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR ANY RELIANCE ON AI OUTPUT.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED CANADIAN DOLLARS (CAD $100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. Nothing in these Terms limits liability that cannot be excluded under applicable law.
19. Indemnification
You agree to indemnify, defend, and hold harmless Kamase Labs Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, Your Content, your violation of these Terms, or your violation of any third party's rights.
20. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in Vancouver, British Columbia, and you consent to the exclusive jurisdiction of those courts.
21. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you via email or through the Service. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
22. General
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Barry regarding the Service.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
- Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
- Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights without restriction.
- Force Majeure: We shall not be liable for delays or failures in performance resulting from causes beyond our reasonable control, including natural disasters, acts of government, or internet service disruptions.
